Federal Energy Tax Credits and Deductions

The Energy Policy Act of 2005 (EPAct) offers businesses federal tax credits and deductions for building energy-efficient residential, multi-family (for sale and for lease), commercial buildings, and for renovating commercial buildings. The Energy Efficient New Home Tax credit (45L) and the Energy Efficient New Buildings deduction (179D) are general business credits/deduction and apply to different entities such as: C Corporations, S Corporations, Partnerships, Individuals, Limited Liability Partnerships (LLP), Limited Liability Company (LLC), Real Estate Investment Trust (REIT), and tax-exempt organizations. A tax credit can be subtracted directly from the total tax liability – a dollar for dollar reduction of taxes due, and may be three or more times more valuable than a tax deduction. A tax deduction is subtracted from income before total tax liability is computed.

If you build low income housing and apply for LIHTCs, ConSol can use the California Energy Commission’s California Utility Allowance Calculator (CUAC) to estimate tenant-paid utilities. The CUAC gives a more accurate estimation of the tenants’ utility costs than the Utility Allowance Schedule generally used.
